Equal Housing Opportunity
We are pledged to the letter and spirit of U.S. policy for the achievement of equal housing opportunity throughout the nation.
Our statement
Upstate Affordable Homes sells, builds and finances homes in compliance with the federal Fair Housing Act (Title VIII of the Civil Rights Act of 1968, as amended), the South Carolina Fair Housing Law (S.C. Code § 31-21-10 and following) and all other applicable laws. We support an affirmative advertising and marketing program in which there are no barriers to obtaining housing because of race, color, religion, sex, national origin, familial status or disability.
This applies to every part of what we do: which homes we show you, the price and terms we offer, how we evaluate an owner-financing application, how we handle trade-ins, which lenders we refer you to, and how we advertise.
Protected classes
Under federal law it is illegal to discriminate in the sale, rental or financing of housing because of:
- Race
- Color
- Religion
- National origin, including ancestry and where you or your family came from
- Sex, which HUD enforces to include sexual orientation and gender identity
- Familial status, having children under 18 in the household, being pregnant, or in the process of adopting or gaining custody of a child
- Disability, physical or mental, including a person who lives with or is associated with someone who has a disability
South Carolina law protects the same classes. Some cities and counties add others. We do not discriminate on any of these bases, and we also do not discriminate because of a person's age, marital status, source of lawful income, military or veteran status, or the kind of loan they use to buy.
What this means in practice
- Every available home is available to every qualified buyer. We do not steer anyone toward or away from a home, a neighborhood or a county.
- The price on the listing is the price for everyone. Owner-financing and trade-in decisions are based on the home, the down payment, income and payment history, using the same standards for every applicant.
- We do not ask about, record or consider any protected characteristic when deciding whether to sell or finance a home, and we do not make assumptions based on a name, an accent, a photo or a family size.
- Families with children are welcome in every home. We do not limit which homes or lots we show to households with children.
- We refer buyers to preferred lenders on the same basis for everyone. Lenders are independent and are themselves bound by the Fair Housing Act and the Equal Credit Opportunity Act.
- Our staff and any agents, contractors or lenders who work with our buyers are expected to follow this policy.
Accessibility and reasonable accommodation
If you have a disability and need a change to our usual rules or practices so that you can view, buy or finance a home, ask us and we will make a reasonable accommodation. If you need a physical change to a home (for example a ramp, wider doorways or a roll-in shower), tell us before the home is finished and we will work with you on it. We also want this website to be usable by everyone. If any part of it is hard to use with a screen reader or other assistive technology, contact us and we will help you directly and fix the problem.
Advertising
Our listings, website, social posts and ads describe the home and the financing, not the kind of buyer we want. We do not use words, photos or targeting that express a preference, limitation or discrimination based on a protected class, and we display the Equal Housing Opportunity logo or statement in our advertising.
How to report discrimination
If you believe you have been treated unfairly by us, by one of our lenders, or by anyone else in a housing transaction, you can file a complaint. There is no cost, and you do not need a lawyer.
